1. Ámbito de aplicación y partes contratantes

Para la totalidad de nuestros suministros tienen validez exclusiva las siguientes condiciones de contratación. Requisitos alternativos sólo serán vinculantes para nosotros después de haberlos reconocido explícitamente.
La parte contratante para todas sus solicitudes de compra es la empresa Neveta Nautica S.L. (Véase señas al final de las CGV).

2. Área de suministro y clientes

En principio, los pedidos y suministros son mundialmente posibles. Por favor tomen en cuenta, en este contexto, nuestra lista de gastos de envío (título: Informaciones)

3. Cierre del contrato

Los contratos en nuestra tienda de Internet, sólo podrán ultimarse en el idioma respectivo que se indica en la tienda.
Usted da una oferta vinculante al haber pasado por el proceso de pedido online, introduciendo las indicaciones que allí se le exigen, y activando el botón “ENVIAR”, en la última fase del proceso de pedido. Después de enviar su pedido, le será remitido un correo electrónico con el que confirmamos haber recibido su orden e indicando los detalles del pedido (acuse de recibo del pedido). Esta confirmación del recibo no constituye una aceptación de su oferta, sino que sirve únicamente para informarle que hemos recibido su pedido. A más tardar, recibirán de nuestra parte toda la información al cliente hasta la entrega del producto. Recomendamos imprimirla para su documentación. El contrato de compraventa no entrará en vigor, hasta que se envíe el producto o se mande un segundo correo electrónico confirmando el pedido.

4. Oferta de productos y pedidos

Por favor, tome nota de que puede haber ofertas, en nuestra tienda online, que tengan un plazo de vigencia limitado. Puede encontrar información detallada al respecto en la descripción del producto respectivo.

5. Almacenamiento del texto contractual

Almacenaremos el texto del contrato de compraventa y, después de acabar con el proceso de pedido, podrá solicitarlo. Directamente después de enviar el pedido, podrá imprimir los datos del pedido. Para tal fin podrá aprovechar o la siguiente página “SU PEDIDO” o el correo electrónico “acuse de recibo”.

6. Precios y ofertas especiales temporalmente limitadas

Todos los precios indicados son precios al consumidor final e incluyen el impuesto sobre el valor añadido alemán (21%). A estos precios, cabe añadirse los gastos de envío. Tiene validez el precio vigente en el momento del pedido.

7. Plazos de entrega y gastos de envío

Nos encargamos de la entrega del producto al cliente a reserva de que nosotros mismos recibamos el producto a tiempo y correctamente, y que no tengamos que responsabilizarnos de la falta de disponibilidad del mismo. A no ser que se haya acordado o que se indique algo diferente para el artículo, suministramos dentro de una semana después de recibido su pedido, siempre que esté disponible en existencias. No podremos garantizar a nuestros clientes el plazo de entrega de los productos, exceptuando los productos en los que expresamente se cite una determinada garantía.

En caso de no poder cumplirse el plazo regular de entrega al cliente, le informaremos por correo electrónico o teléfono.

Por favor tomen nota: En los envíos realizados a países no pertenecientes a la Unión Europea, no asumiremos los gastos correspondientes a impuestos y aranceles aduaneros propios de cada país que pudieran surgir. Encontrará más información al respecto bajo el punto “gastos de envío” o consultando con nosotros directamente.

8. Garantía

Adicionalmente a las garantías legales, tendrán validez las disposiciones de garantía respectivas que se añaden al artículo.

En caso de que el artículo entregado presente daños materiales, defectos de fábrica o daños inherentes al transporte, por favor, comunique en seguida este tipo de defectos al transportista que le ha entregado el producto y, adicionalmente, a nosotros. El cumplimiento del arreglo pertinente, no afectará sus derechos legales, siempre y cuando haya hecho el pedido como consumidor final con fines privados.

9. Pago (SSL)

Para protegernos contra el riesgo de crédito y en función de la solvencia respectiva de los clientes, tendremos que reservarnos, el derecho de entregar el producto solicitado por Usted sólo contra reembolso/pago inmediato en su punto de entrega al cliente. En este caso, puede aceptar estas condiciones o renunciar a su pedido.

Le ofrecemos las siguientes formas de pago:

10. Información sobre el derecho de rescisión

Derecho de rescisión

Podrá usted rescindir su derecho de contrato en un plazo de ocho días, por escrito (por ejemplo, carta, fax o correo electrónico) o, sin indicar los motivos –si se ha entregado la mercancía antes de la expiración del plazo– mediante la devolución de ésta. El plazo comenzará a contar no antes del día de recepción del producto por parte del destinatario (en el caso de entrega periódica de bienes de igual naturaleza, no antes del día de recepción de la primera entrega parcial) y no antes del cumplimiento de las obligaciones de información, previstas en el artículo 246 § 2 en relación con el artículo § 1, apartados 1 y 2 de la Ley de introducción del Código Civil alemán (EGBGB), así como nuestras obligaciones conforme al artículo § 312e apartado 1, primera frase del Código Civil alemán (BGB) en relación con el artículo 246 § 3 EGBGB. Para el cumplimiento del plazo de rescisión, bastará con el envío en tiempo oportuno de la declaración de rescisión o la devolución de la mercancía.

Consecuencias de la rescisión

En caso de rescisión válida, deberán restituirse las prestaciones recibidas por ambas partes y, en su caso, el beneficio obtenido (por ejemplo, intereses). Si no puede usted restituirnos, en todo o en parte, la prestación recibida o bien sólo puede hacerlo en una condición deteriorada, deberá abonarnos una indemnización. En el caso de entrega de mercancías, no será aplicable lo anterior cuando el deterioro se deba exclusivamente a su examen – tal como habría sido posible efectuarlo en un local comercial. Además, podrá evitar la obligación de indemnizar por el deterioro del producto, debido a su uso normal, no utilizando el producto como si fuera de su propiedad y absteniéndose de todo aquello que pueda menoscabar su valor. Los productos susceptibles de ser enviados en paquetes serán devueltos por su cuenta y riesgo. Usted se encargará de los costes de devolución de la mercancía.

La obligación de reembolso de los pagos deberá cumplirse dentro de un plazo de 30 días. El plazo de rescisión comenzará para Usted con el envío de la declaración de rescisión o la devolución de la mercancía, y para nosotros con la recepción de la misma.

Exclusión del derecho de rescisión

Se excluyen en particular del derecho de rescisión los contratos de suministro de bienes, confeccionados conforme a las especificaciones del consumidor o claramente personalizados, o que, por su naturaleza, no puedan ser devueltos.

11. Devolución de productos

¿Usted quiere devolvernos un producto adquirido? Por favor, envíe una copia de la factura con las siguientes indicaciones: Razón de la devolución, procedimiento deseado y su relación bancaria en caso de un posible reembolso. 12. Zona de jurisdicción

En casos de una compraventa mercantil bilateral, quedará acordado como lugar de jurisdicción la sede social del vendedor. En el comercio con consumidores finales dentro de la Unión Europea, podrá aplicarse también el derecho en el domicilio del consumidor final, siempre y cuando se trate obligatoriamente de estipulaciones de derecho de consumidores. En caso de que un consumidor final privado no disponga de un domicilio dentro de la Unión Europea, servirá de lugar de jurisdicción nuestra sede social.
